BOOKING CONDITIONS

  1. All vehicles are booked by the agents, Autos Espana and this will be confirmed by e-mail to the Client. When the Client collects the vehicle on mainland Spain, Mallorca or on the Canary Islands he or she will be required to enter into a written contract with the Rental Company. Such contracts will incorporate the following booking conditions:


  2. Only the Client and any other drivers named in each contract with the Rental Company may drive the vehicle. All drivers must be over 21 years and have held a valid licence for 12 months. Spanish Law requires drivers to hold either a European Driving Licence or a licence issued by another country which is accepted by the Spanish Authorities. All drivers must present their driving licences at the vehicle collection point. An International Driving Permit may be necessary for clients domiciled in certain countries and clients should check this with the Spanish Embassy or Consulate in their own country. Spanish Law also requires drivers to carry their licences, passports and vehicle hire contracts with them at all times. A maximum of 4 drivers is permitted per vehicle.


  3. The maximum rental period is 90 days. Cars collected on the Spanish mainland MUST be returned to one of the Rental Company's designated Spanish mainland locations. On Mallorca, cars may be returned to either of the Rental Company's Mallorca offices. Cars collected from a Canary Island location must be returned from whence they were initially collected. Vehicles may be taken from Spain to Gibraltar and Portugal, but only from Almeria, Granada, Malaga, Jerez or Sevilla and also to France and Andorra, but only from Gerona or Reus. Similarly, cars may be taken from Mallorca to other Balearic islands. Also in the Canary Islands, from Tenerife, Fuerteventura, Gran Canaria or Lanzarote to other islands in the Canaries. There are additional fees for this service payable at the pick-up locations (please consult our FAQ for the current costs). Payment must be made either with a DEBIT card, provided that the Goldcar "Relax Top-Up Insurance" has been purchased, or with a CREDIT card. Whichever type of card is used it must be in the name of the principal driver. The Rental Company must be advised of such arrangements when the car is collected. It should be remembered that in the event of a vehicle breakdown, the normal service from the Rental Company may take longer than it would in Spain and may not be available in the Balearics and Canaries on other local islands. Cars collected on the Spanish mainland MUST be returned to one of the Rental Company's designated Spanish mainland locations. Cars collected from Mallorca or a Canary Island location must be returned from whence they were initially collected.


  4. Vehicles may be collected at any specified Spanish mainland point and returned to another specified Spanish mainland point and also on Mallorca between the airport and the Palma down town office and between Tenerife North & South airports. There is no extra charge for this service for rentals of 7 days or more. The minimum period charge for all journeys is equivalent to a 3 day rental.


  5. All bookings (excluding fuel and any other local charges) must be paid for with a deposit at the time of booking using a credit or debit card. The balance must be paid when the vehicle is collected with either a DEBIT card, provided that the Goldcar "Relax Top-Up Insurance" has been purchased, or with a CREDIT card. Whichever type of card is used it must be in the name of the principal driver. Unless previously confirmed in an amended voucher, an extension to a booking period, with the consequent balance payment, or a balance payment adjustment for a reduced booking period is subject to the rental company's discretion when any such balance payment is due.


  6. Local charges are payable on collection of the vehicle and include the balance of the car rental, fuel costs, young and inexperienced drivers' fees, additional driver charges, baby/child seat costs, diesel-engined car surcharges and the optional additional insurance premiums as described in Clause 14 (please consult our FAQ for fuller information and the current costs). Fuel charges are subject to change without notice due to market fluctuations. Payment for all local charges MUST be made only by the named principal driver either with a DEBIT card, provided that the Goldcar "Relax Top-Up Insurance" has been purchased, or with a CREDIT card. Whichever type of card is used it must be in the name of the principal driver. American Express, Diners Cards and Cash will not be accepted. A full tank of fuel is supplied and the Client returns the vehicle with an "empty" tank. There are no refunds on unused fuel, except for hire periods of 3 days or less when the value of the remaining fuel in the vehicle will be refunded to the hirer's credit card account. Fuel charges are based on the car manufacturer's specified fuel tank capacity for each model of car and the prevailing price of fuel as given on the Spanish Ministry of Trade and Tourism Website (www.mityc.es). The prices are not based on petrol station prices. Petrol driven vehicles are supplied with 98 octane fuel as recommended by the majority of vehicle manufacturers.


  7. The vehicle-hire price prevailing at the time the booking is made, is guaranteed against any increase. This guarantee is subject to the conditions of payment being adhered to as stated in Section 4. above. The Rental Company reserves the right to revise published prices at any time before bookings are made. Any amended booking will be subject to the rate which prevails at the time the amendment is made.


  8. The Rental Company reserves the right to allocate any model of vehicle within the stated vehicle group.


  9. Vehicles are only insured until the vehicle's return time stated on the contract or 30 minutes before the Client's return flight check-in time, whichever is earlier (please see FAQ "Late Return of Rental Vehicles" for any period of grace). All vehicles and keys must be returned to the Rental Company's designated office by the earlier time. Clients are liable for late return charges. The times quoted on all documentation are local times.


  10. Any cancellation or failure to collect a vehicle will incur the loss of the booking deposit.


  11. It is illegal to exceed the nominal carrying capacity of the vehicle. Therefore the number of passengers (including the driver and children) should not exceed those stated on the Tariff and General Information leaflet. Child seats are required by law.


  12. The vehicle's insurance will be invalidated if the vehicle is driven while under the influence of alcohol or drugs and in the event of an accident the Client may be held responsible for all damages.


  13. All accidents, vehicle damage and vehicle theft must be reported to the Rental Company within 24 hours of such damage. Also the police should be informed immediately and a copy of the police report obtained; this is mandatory in the event of an injury.


  14. Vehicle insurance does not cover Clients' personal property stolen from the vehicle and Clients are responsible for incurred traffic fines and the loss of car keys. Clients are also responsible for the uninsurable risks of damage to wheels, tyres, wheel-trim, underbody, window glass and the interior of the vehicle if such damages occur independently and are not associated with general traffic accidents or total losses. Towing costs are not usually covered. Also charges will be made for special car cleaning (if returned exceptionally dirty) and unnecessary call-outs caused by clients or members of their party together with any consequential costs. Damage in isolation to wheels, tyres, trims, windows, undercarriage, clutch, car interior, towing costs and the loss of car keys may be insured locally at the vehicle collection point with a payment per rental, as currently given in our FAQ. Payment must be made either with a DEBIT card (provided that the Goldcar "Relax Top-Up Insurance" is purchased) or with a CREDIT card. Whichever type of card is used it must be in the name of the principal driver (please see FAQ "Insurance" for full information). The vehicle insurance covers all drivers whose names and driving licence details are entered by the rental company on the rental contract.


  15. Clients who return their cars later than the specified return time will incur a penalty (please see FAQ "Changes in Your Booking or Extension"). Additionally they will incur the relevant car group daily rate if the contract is not properly extended. Similarly, if the vehicle is returned in an excessively dirty condition, clients will be charged for any special car cleaning (please see FAQ "Dirty Cars"). We regret that this measure has had to be taken because of increased and costly abuse by a growing number of clients.


  16. It is expressly forbidden to remove any car seat from a rental vehicle, including such seats which may be designed for temporary removal from multi-purpose vehicles (MPV's).


  17. In the unlikely event of a complaint, the Rental Company must be notified immediately and if not resolved, the complaint MUST be put in writing and sent by e-mail to info at autosespana.com within two weeks of returning the vehicle to the Rental Company. The AE...... booking reference number MUST ALWAYS be quoted in the Subject Line of the email. Alternatively, a complaint may be sent by post to Autos Espana, PO Box 274, Penryn, TR10 8EY.


  18. The Rental Company reserves the right at their absolute discretion to terminate without notice the vehicle rental arrangements of any Client whose behaviour is such that it is likely in their opinion to cause distress, damage, danger or annoyance to their Clients, employees, property or to a third party. Should any passenger be prevented from travelling because in the opinion of any person in authority, they appear to be unfit to hire or drive the vehicle, then the responsibilities of Autos Espana, the Rental Company and any other party contracted to supply any or all aspects of the rental will thereupon cease. In this event, full cancellation charges will apply.


  19. Liabilities - Autos Espana act only as booking agents for the Rental Company supplying the vehicles and cannot be held responsible for loss, damage, delay, injury, death, cancellation, alterations, irregularity or additional expenses suffered by the hirers or members of their parties whatsoever. The Clients therefore contract directly with the Rental Company and are subject to both its Standard Conditions and Spanish Law.
